Witness protection act draft in Bombay High Court

The Bombay High Court on Monday, 21st of December 2015 asked the State government to consider including RTI activists and whistleblowers in the Maharashtra Witness Protection Bill.

The bill states that protection will only be provided to those witnesses who will depose in a trial for “serious offences” and where the accused is awarded “death penalty or life sentence”.

The draft of the Bill was submitted to a division bench of Justice Abhay Oka and Justice Gautam Patel by state counsel Nitin Deshpande.

The court has asked the state to look into widening the scope and definition of “serious offences” and also the punishment of “death or life sentence”.

The court has suggested that the ambit of the bill should also include protection of ‘police witnesses’ who not only depose in the higher courts but all those that come to the trial court. The State sought time to file its reply and adjourned the matter till February 8.

The court was hearing a suo motu (on its own) petition after Satish Shetty (38), RTI activist known for exposing land scams in Maharashtra, was killed.

The proposal also requires them to provide extensive personal background data, including criminal history, property and sources of income.

MANILA, Philippines—Witnesses will be able to undergo plastic surgery, even a sex change, while whistle-blowers will get monetary rewards under two new bills the House justice committee approved on Wednesday in order to provide stronger protection and additional benefits to people who speak out against crime and corruption.

The whistle-blowers protection, security, and benefit bill and the witness protection security and benefit bill also provide harsh penalties for those making false claims.

The committee’s approval of the measures comes as whistle-blowers and cohorts turned state witnesses take a central role in the current investigations into the billions of pesos in state funds that had been ripped off through the years.

Relocation

A Witness Protection Bureau under the Department of Justice will be set up if the first measure is approved.

The bill states that a witness will be entitled to relocation and a change in personal identity at government expense with the right to secure housing and relocation for relatives within the second civil degree of consanguinity under threat.

It further states that the change of personal identity “may include a change in physiological appearance or change of name.”

Sex change

Iloilo Rep. Niel Tupas Jr., the committee chair, said that changing the physical appearance of a witness could entail undergoing plastic surgery.

“That’s a new provision. You could even undergo a change of sex,” Tupas told reporters.

Under the bill, the justice secretary may also order a change of the witness’ name without a separate judicial order or administrative proceeding.

It also prohibits witnesses from talking with any adverse party or entering into an amicable settlement on the civil or criminal aspect of the offense.

4 to 6 years

A prison sentence from four to six years will be imposed on a witness who desists or contravenes his original affidavits, fails to appear during hearings without a valid reason, refuses to cooperate or testify in the investigation or gives false and misleading testimony.

This witness will also be required to pay back expenses for his protection.

Rewards

The second bill would grant rewards from P50,000 to P200,000 to whistle-blowers at various stages of participation.

If revelations lead to the filing of cases of plunder, forfeiture of ill-gotten wealth, bribery, malversation and the like, the witness will be entitled to an additional reward of 10 percent of the actual amount recovered by final judgment.

But if the whistle-blowers deliberately give false and misleading information, they will suffer the penalty for the crime they were called to provide evidence.

Those who coerce or compel a witness to give misleading information will be penalized with imprisonment for the crime concerned and asked to reimburse protection expenses.

Reservations

During the hearing , Deputy Ombudsman Gerard Mosquera said he had reservations about the provision of monetary rewards.

He said this could create an industry of “bounty hunters” instead of encouraging people to perform their civic duty.

Cebu Rep. Gabriel Luis Quisumbing, one of the bill’s authors, said financial reward was incorporated into the bill because many of the whistle-blowers, after speaking out, decide not to continue going to their workplaces to avoid retaliation. Many of them also choose to move on to other professions.

The reward will provide them with something they can use to start a new life, Quisumbing added.

Penalties

Mosquera also said the penalties might discourage whistle-blowers. He said that if a case stemming from a whistle-blower’s exposé was dismissed, this may be cause for retaliation.

But Tupas said the penalties should only scare away fake whistle-blowers, and that the dismissal of a case did not necessarily mean false information was provided.

“It will have a chilling effect on the non-genuine whistle-blowers,” he said.

Schweiz schafft Zeugen-Schutz-Programm

Ab 2013 arbeiten 10 Beamte für die nationale Zeugenschutzstelle, welche zur Hälfte von Bund und Kantonen finanziert wird. Unter anderem erhofft sich die Polizei so Ermittlungs-Erfolge beim Menschen-handel.

Umstrittenes Zeugenschutzprogramm

Im internationalen Vergleich hinkt das Schweizer Zeugenschutzprogramm hinterher. Künftig sollen Zeugen, die sich durch ihre Aussage in Gefahr bringen, mit einer neuen Identität ausgestattet werden können. Gegner befürchten, dass auch Kriminelle vom neuen Zeugenschutz profitieren.

Zeugenschutz in den USA - Witness Security Program

Der US Marshals Service sorgt für die Sicherheit der US-Regierung. Zeugen und ihre unmittelbaren Angehörigen, deren Leben in Gefahr sind als Folge ihrer Aussage gegen Drogenhändler , Terroristen, Mitglieder der organisierten Kriminalität und anderen kriminellen Vereinigungen können in das Witness Security Program aufgenommen werden.

Das Witness Security Program wurde durch den Organized Crime Control Act von 1970 zugelassen und geändert durch den umfassenden Crime Control Act von 1984. Die US-Marshals haben seit Beginn des Programms im Jahr 1971 mehr als 8.500 Zeugen und 9.900 ihrer Familienmitglieder geschützt, verlegt und mit neuen Identitäten versehen.

Die erfolgreiche Durchführung des Programms ist in den USA als eine einzigartiges und wertvolles Instrument im Kampf der Regierung gegen die großen "kriminellen Verschwörer" und organisierte Kriminalität anerkannt.

Zeugen und ihre Familien erhalten in der Regel eine neue Identität mit authentischer Dokumentation. Wohnen, Lebensunterhalt für die grundlegenden Lebenshaltungskosten und die medizinische Versorgung werden den Zeugen zur Verfügung gestellt. Job- Ausbildungs- und Beschäftigungshilfe kann auch vorgesehen werden.

Die US-Marshals bieten 24 -Stunden- Schutz für alle Zeugen, während sisich diese in einem Bedrohungsszenario befinden.

Nach Angaben der US Regierung ist bislang kein bedrohter Zeuge, der die Sicherheitsrichtlinien befolgt hat, als Teilnehmer eines Zeugenschutzprogramms unter dem aktiven Schutz der US Marshals geschädigt worden.

In Straf-und Zivilsachen kooperieren die US Marshals mit geschützten Zeugen vollständig mit der örtlichen Polizei und Gerichtsbehörden, um Zeugen vor Gericht zu bringen oder ihre gesetzlichen Aufgaben zu erfüllen.

The California Witness Relocation and Assistance Program (CalWRAP) provides protection of witnesses and their families, friends, or associates who are endangered due to ongoing or anticipated testimony in gang, organized crime, or narcotic trafficking cases or in other cases that have a high degree of risk to the witness. The CalWRAP reimburses California's District Attorneys for expenses incurred by agencies during the protection of witnesses.
